Unlawful arrest: official gets payout

A former department of home affairs official who was unlawfully arrested for allegedly being involved in a marriage scam, will receive R50 000 in damages from the Minister of Safety and Security.

Pretoria High Court Judge Brian Southwood said Francina Kilian was at the time of her arrest a fairly senior and responsible employee of the department, where she had worked for 13 years.

 

She was a marriage officer and responsible for entering particulars of marriages in the department's marriage register.

She had never been the subject of a departmental disciplinary action.

Kilian was arrested in the middle of the day and taken by two policemen in uniform to their van, in full view of her colleagues and members of the public.

She was held in a cell at Pretoria Central police station for 25 hours.

Kilian wanted a total of R321 500 in damages, but Southwood said she could only prove unlawful arrest and that R50 000 should compensate her for the injury to her feelings. ...
